* 아래 시는 James Boyle 의 ｢제2의 종획운동과 공적 도메인의 구축｣(The Second Enclosure Movement and the Construction of Public Domain)(2006)의 서두에 인용된 시이다. 작자 미상이며 정확한 창작 시기도 미상이고 대략 18세기 후반으로 추정된다. (제목도 없다.)  제임스 보일은 듀크 대학의 법학 교수이다. 이 논문은 크리에이티브 커먼즈 라이센스의 조건으로 http://creativecommons.org/licenses/by-sa/1.0에서 볼 수 있으며 또한 http://www.law.duke.edu/journals/66LCPBoyle에서 볼 수 있다. 

The law locks up the man or woman

Who steals the goose from off the common

But leaves the greater villain loose

Who steals the common from off the goose.

 

The law demands that we atone

When we take things we do not own

But leaves the lords and ladies fine

Who take things that are yours and mine.

 

The poor and wretched don’t escape

If they conspire the law to break;

This must be so but they endure

Those who conspire to make the law.

 

 

The law locks up the man or woman

Who steals the goose from off the common

And geese will still a common lack

Till they go and steal it back.

 

(공유지에서 거위를 훔쳐가는 사람들을

법이 잡아가두네.

하지만 거위에게서 공유지를 훔쳐가는

더 큰 악당은 잡아가지 않네.

 

우리가 우리 것이 아닌 것을 가져가면

보상해야 한다고 법이 요구하네.

하지만 그대들과 나에게 속한 것들을 가져가는

지주들과 그들의 부인들은 그냥 놔두네.

 

가난하고 천한 자들이 법을 어기는 모의를 하면

도망가지 못하고 잡히네.

이건 이래야 한다지만, 법을 만드는 모의를 하는 자들은

왜 그냥 놔두는 것인지.

 

공유지에서 거위를 훔쳐가는 사람들을

법이 잡아가두네.

가서 공유지를 다시 훔쳐올 때까지

거위들에겐 공유지가 없네.)
